If you wish to appeal against a construction or compliance infringement, you must complete the below form.

You will need to complete all fields to ensure that the Yarra City Council can process your appeal.

For your records, a copy of your request will be sent to your email address.

The Victorian Infringements Act 2006 provides four specific grounds for review. Please select one of the grounds listed below

You are appealing under the grounds of Special Circumstances

Special circumstances apply where the offender is homeless, has a mental or intellectual disability, is addicted to drugs or alcohol, or suffers from a condition which results in the person being unable to understand the offending conduct, or unable to control the conduct. If you select this ground of review, you must include official letters of support or other documentation from treatment providers such as medical practitioners, social workers or drug and alcohol counsellors.
You are appealing under the grounds of Contrary to Law (e.g. you believe no offence took place)

You must provide details about why you believe the decision to issue the infringement notice is unlawful.
You are appealing under the grounds of Exceptional Circumstances.

Exceptional circumstances include unforeseeable or unpreventable circumstances where the offender was not able to prevent the offence from occurring.

Council has authority to decide whether your situation counts as exceptional or not. You must prove the situation was serious and beyond your control. and have good supporting evidence. Please attach before submitting your review.
You are appealing under the grounds of Mistake of Identity (e.g. you were not the person or corporation who committed the offence)
Has the infringement been issued to a individual/sole trader or corporation? *This question is required.
You have selected Mistake of Identity as the grounds for this appeal. You must nominate an individual/sole trader or company as the person or corporation who committed the offence. If you are nominating on behalf of a corporation you must be an authorised officer. *This question is required.
