TINCUP ‘BARBACK HERO’ COMPETITION 2017
TERMS AND CONDITIONS
 
By entering this Promotion (as defined below), both the Bartender (as defined below) and the Barback (as defined below) will be deemed to have accepted these terms and conditions (“Terms and Conditions”), and agreed to be bound by them. The Promoter (as defined below) reserves the right to amend these Terms and Conditions at any time.
 
PROMOTER
  • The promoter is Proximo Spirits UK, 80 Coleman Street, Moorgate, London, EC2R 5BJ (“Promoter”).
  • Steely Fox Ltd, Protein Studios, 31 New Inn Yard, London, EC2A 3EY (“Agency”) is responsible for administrative aspects of the Promotion (including technical support, etc.), with the assistance of Imbibe Media Ltd, Gateway House, 28 The Quadrant, Richmond TW9 1DN.

ENTRY PERIOD
  • Starting date: 10:00am (UK time) on 8th May 2017.
  • Closing date: 11:59pm (UK time) on 5th June 2017.
  • Any entries received after the closing date will not be considered for inclusion into the Promotion.
WHO MAY ENTER
  • This competition (“Promotion”) is open to UK-based Bartenders and Barbacks aged 21 or over.
  • The nominator should currently hold the position of either bartender, bar supervisor, bar manager or bar owner (“Bartender”).
  • The nominated barback (“Barback”) must work in the same venue as the Bartender at the time of entry.
  • The following may not enter or win a prize: (a) employees of Promoter or its agencies (including the Agency) and their family members and (b) anyone else who is directly or indirectly professionally connected with the Promotion or the Promoter and/or their family members.
LIMITATIONS / RESTRICTIONS ON ENTRY
  • One entry per Bartender and Barback team.
  • The Bartender and Barback cannot represent more than one bar.
  • Incomplete entries and entries that do not comply in full with these Terms and Conditions will be disqualified and will not be counted.
  • Internet access is required to enter.
HOW TO ENTER
 
First Round:
  • To enter tell us your Barback’s ‘hero moment’ in 200 words or less.
  • By entering, both you and your Barback will be entered into the competition as a “team”.
  • Entries to be submitted via the Imbibe website www.imbibe.com/tincup.
  • All sections of the online entry form are to be completed to be considered an official entry.
  • Written entries to be no longer than 200 words.
  • Those that exceed this limit will be disqualified.
  • No video, photo or other multimedia entries can be accepted.
  • Any entries submitted must have been created and owned in whole by the entrant.
  • The Promoter reserves the right to reject entries based on incomplete information being provided or inappropriate content / language.
  • Applicants submitting incomplete or disqualified entries will not be contacted.
FINALIST SELECTION AND NOTIFICATION
  • The Promoter may ask for a photograph of the Bartender and Barback team at work, prior to or during the judging process, to validate the entry.
  • Entries will be reviewed by a judging panel including Elliot Ball from The Cocktail Trading Co., Gareth Canny from London Union, Chris Dennis from Disrepute and representatives from the Promoter and the Agency.
  • Twelve teams (a team will consist of the nominating Bartender and nominee Barback) of Finalists (as defined below) will be selected from all complete, correct and eligible entries received before the closing date. Finalists’ entries will be determined in the opinion and sole discretion of the judges.
  • Finalists’ will be contacted by telephone or email using the details supplied at time of entry within 14 days of the competition closing date.
  • Entrants should ensure they check their spam/bulk/junk folders for notification because if a response from a finalist is not received within 7 days of the notification being made, a Finalist may lose their place in the live final. Proof of age, identity and eligibility may be required in order to progress to the live Final (as defined below).
  • Unsuccessful applicants will not be contacted.
Final:
  • The chosen 12 Barback and Bartender teams (“Finalists”) will appear at a live barback challenge (“Final”) in London to be completed in teams of two to test bar industry skills.
  • The Final will take place on 4th July 2017 in Greater London.
  • Finalists should be available from 9am to 9pm on the 4th July 2017.
  • Full details of the event will be confirmed 7 days before the Final.
  • Challenges will be set during the Final that tests Finalists’ teamwork, aptitude and initiative plus other bar industry skills.
  • Finalists will be set both quantitative and qualitative assessment tasks. Some tasks will be judged live by an industry panel including: Elliot Ball from The Cocktail Trading Co., Gareth Canny from London Union, Chris Dennis from Disrepute Bar and representatives from Imbibe Magazine, the Promoter and the Agency.
  • Travel and accommodation for Finalists living more than 1 hour from Greater London may be paid for by the Promoter.
WINNER SELECTION AND NOTIFICATION
  • The overall competition Winners (as defined below) will be announced on the night of the Final.
  • Promoter’s and judges’ decisions are final and binding in all respects on all entrants and no correspondence will be entered into with respect to such decisions.
STANDARDS FOR ENTRIES
  • The Promoter expressly reserves the right to disallow or disqualify (or prevent from passing through the judging stage) any entry which it considers does not meet normal standards of taste and decency.
PROMOTER’S USE OF CONTENT
  • By entering the Promotion, entrants grant the Promoter, its affiliated companies and its sub-contractors the right to use any entries (”Content”) supplied to the Promoter in connection with the Promotion:
a) for the purposes of administering the Promotion;
b) for promotional and publicity purposes; and
c) in all digital and social media in connection with the Promoter and the Promotion.
  • To the extent permitted by law, entrants hereby waive in favour of the Promoter and agree not to assert any moral rights (or similar rights worldwide) in and in connection with their Content.
PRIZE
  • The overall grand prize for the winners is a trip to Colorado for the winning team of Bartender and Barback (“Winners”) plus additional activities to be confirmed. The prize includes return flights to Colorado from a suitable UK airport, hotel transfers in Colorado and all hotel accommodation (based on shared room occupancy). Certain other costs and expenses, such as food and drink and other entertainment, may be paid for by the Promoter. Other costs, such as travel insurance, transfer to the Winners’ departure airport, food and drink purchased outside of the main trip events and meals and other additional costs that arise are the responsibility of the Winners.
  • The Winners may be asked to participate in a bartending shift on one of the flights to or from Colorado for additional publicity purposes
  • It is the Winners’ responsibility to ensure they have valid passports, visas, travel documents and vaccinations in order to be able to take up the prize. The prize does not guarantee the Winners’ entry to the USA.
  • The prize trip must be taken on the dates organised by the Promoter (estimated to take place during the month of October 2017). The exact dates of the prize are to be confirmed. Rearranging the dates due to the Winners being unavailable for any reason will not be possible.
  • Please note that the prizes do not include personal expenditure and other incidental costs other than those specifically included.
  • The Promoter reserves the right to substitute the prizes (or any part thereof) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond its reasonable control. There is no cash alternative to the prizes (or any part thereof) and unless the Promoter agrees otherwise in writing the prizes are non-refundable and non-transferable.
  • Details of Winners’ name will be available for one month after the closing date by writing to the Agency at the contact details above and stating the name and date of the Promotion.
LIABILITY
  • References to the “Promoter” in this Liability section include all of the Promoter’s associated companies, agencies or any other third parties involved in the Promotion.
  • The Promoter cannot accept any responsibility for any damage, loss, death or injury suffered by any entrant entering the Promotion or as a result of accepting any prize.
  • The Promoter will not be responsible for (and will have no liability in connection with) the following occurrences, to the extent that they occur for reasons beyond the Promoter’s reasonable control:
a) any postponement or cancellation of the Promotion;
b) any changes to the prizes or the way in which they can be used
  • The Promoter does not accept responsibility for network, computer, hardware or software failures of any kind, which may affect the sending, receipt or processing of your entry or for entries lost, damaged, delayed or unreadable, including loss of entries through technical fault or transmission delays.
  • If the Promoter has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating the Promotion, choice of prize Winner(s) or any entry (or establishing multiple registrations in order to gain multiple entries where the number of entries is limited)), the Promoter reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity.
  • The winner should be in good health and appropriately fit for travel and waive any claim they may have against the Promoter for any safety or health issue or problem they may have during travel.
PERSONAL DETAILS AND PUBLICITY
  • The Promoter will use entrant’s personal details for the purpose of administering this Promotion only. Please see the Promoter’s Privacy Policy at http://www.proximospirits.co.uk/privacy/ for further details.
  • By entering this Promotion, both entrants (Bartender and Barback) agree that if they are Finalists or the Winners they will grant the Promoter the free use of their name, country of residence, photographs, video and voice (“Image”) for advertising, publicity and news purposes in any media in perpetuity without additional remuneration.
  • The Winners will be asked to take part in reasonable publicity and public relations activities in connection with the Promotion until December 31st 2018.
  • All 12 Barback Finalists agree that they will participate in a photoshoot and they allow their Image to appear in a 2018 printed calendar.
  • The winning Barback also agrees that he/she will make a short diary, both written and visual, of his/her winning trip to Colorado.
ENGLISH LAW APPLIES
  • This Promotion, and any dispute or claim arising out of or in connection with it (including the prizes), shall be governed by and construed in accordance with English law and entrants irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
