Timeframes

It usually takes about 1 month to assess, process and issue an encroachment licence. This can take longer if your application is not complete and missing the required information listed below, or if it’s a complex encroachment.

What we need from you

  • Accurate plans to scale including elevations (preferably survey drawings) must show:
    • property boundaries and dimensions of proposed structures
    • location of existing and proposed structures
    • public footpaths, kerbs, fences, handrails, retaining walls, safety fences
    • power poles, streetlights, utility boxes and any other services
    • dimensions of setbacks from the kerb edge
    • any affected vegetation and mitigation planting (if any)
    • affected accessways both public and private (if any)
    • gradients and the finished ground levels, if these will be altered.
  • Comments from service authorities
  • Comments from adjoining property owners
  • Payment of the application fee

Remember you need to meet the encroachment setback and height clearance guidelines. The basic guideline is:

  • Car park 6 x 3 metres with a further setback from the kerb face:
    • 1.7 metres for carpads, cardecks
    • 2.7 metres for garages, carports
  • Canopies at least 2.4 metres above footpath with setback of 450mm from kerb face
  • Balconies at least 3.0 metres above footpath
  • Fences 1.0 metre in height
